§ 32-29. Enforcement.

  • (a)

    Permits.

    (1)

    Every person operating trucks in the business of collecting, hauling and disposing of any rubbish, garbage, refuse or industrial waste must procure a permit and pay an annual permit fee.

    (2)

    A permit will be issued upon presentation of a vital state permit issued in accordance with the state solid waste management program and shall expire on December 31 of each year and may be renewable annually.

    (3)

    The permit fee shall be in the amount as established in section 14-32(2).

    (4)

    It is unlawful to transfer permits from one person to another.

    (b)

    Inspection. The parish president or his designee has the power to enter at reasonable times upon private or public property for the purpose of inspecting and investigating conditions relating to the enforcement of this part.

    (c)

    Liability for violations. The parish president or his designee may suspend or revoke permits if an order is issued and corrective action has not been taken within the time specified in the notice.

    (d)

    Injunctive powers. Whenever an emergency exists involving a serious health hazard, the responsible authority may, without notice or hearing, issue a written order reciting the conditions violating this article that require corrective action to remove such health hazard. If such action is not taken, the responsible authority may take such action as may be necessary to protect the public health.
